These Terms of Use (“Terms”) govern your access to and use of the websites, applications, courses, tools, and related services (collectively, the “Services”) provided by Jason Conaway Architect, Incorporated (“Company,” “we,” “our,” or “us”), which markets certain services under the brand name Remodel Navigator. By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Services.
1. Eligibility
You must be at least 18 years old to use the Services. By using the Services, you represent and warrant that you meet this requirement and have the legal capacity to enter into this agreement.
2. Scope of Services
Remodel Navigator provides educational, consulting, and informational resources to assist homeowners in planning and managing the pre-construction phases of remodeling projects. Unless otherwise expressly agreed in writing under a separate contract, the Services do not include:
Architectural design documents or architectural services;
Engineering services;
Construction work or contracting services.
No content, advice, or materials provided through the Services shall be interpreted as professional architectural, engineering, legal, financial, or construction advice. You are responsible for consulting appropriate licensed professionals before acting on any information from the Services.
3. Account Registration
To access certain features, you may be required to create an account. You agree to provide accurate, complete, and current information and to update it as needed. You are solely responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
4. Intellectual Property
All content and materials available through the Services, including but not limited to text, graphics, logos, videos, tools, templates, and software, are the property of the Company or its licensors and are protected by intellectual property laws.
Free Resources: You may share our free resources for non-commercial purposes provided you do not alter them and give proper attribution.
Paid Content: You may not copy, redistribute, sell, sublicense, or publicly display any paid content, tools, templates, or materials without our prior written consent.
5. User Conduct
You agree not to:
Use the Services for unlawful purposes or to violate any third party’s rights;
Upload, transmit, or share content that is harmful, harassing, defamatory, obscene, or otherwise objectionable;
Attempt to interfere with or disrupt the security or functionality of the Services.
6. Termination
We may, in our sole discretion and without prior notice, suspend or terminate your account and/or access to the Services for any reason, including but not limited to:
Violation of these Terms or any other policy referenced herein;
Behavior that we determine, in our sole discretion, to be harmful, abusive, harassing, defamatory, or otherwise objectionable toward the Company, our users, or third parties;
Use of the Services for unlawful purposes or to violate the rights of others; or
Technical, security, or legal issues that require such action.
Upon termination, your right to use the Services will immediately cease. We are not liable to you or any third party for termination or suspension of your account, loss of access, or loss of any content or data.
If your account is terminated due to your violation of these Terms, you are not entitled to any refund of amounts paid.
7. Payment and Refunds
If you purchase Services, you agree to pay all applicable fees using one of our approved payment methods. All payments are subject to our Refund & Payment Policy, which is incorporated into these Terms by reference. The Refund & Payment Policy, available at www.remodelnavigator.com/refund-policy, contains the complete terms governing refunds, chargebacks, and payment disputes. In the event of any conflict between these Terms and the Refund & Payment Policy, the Refund & Payment Policy will control.
8. Limitation of Liability
To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Services. Our total liability for any claim shall not exceed the amount you paid for the applicable Service.
9. Indemnification
You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:
Your use of the Services;
Your violation of these Terms; or
Your violation of any rights of another person or entity.
10. Force Majeure
We will not be liable or responsible for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to natural disasters, war, terrorism, labor disputes, government orders, internet or telecommunications outages, or the failure of hosting or platform providers.
11. Severability & Waiver
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision shall not constitute a waiver of our right to enforce it at any time.
12. Survival
Any provisions of these Terms that by their nature should survive termination, including but not limited to intellectual property rights, limitations of liability, indemnification, and payment obligations, shall survive termination.
13. Assignment
We may assign or transfer our rights and obligations under these Terms to any affiliate or in connection with a merger, acquisition, or sale of assets, without notice to you. You may not assign your rights or obligations without our prior written consent.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any disputes shall be resolved exclusively through binding arbitration in San Luis Obispo County, California, in accordance with the rules of the American Arbitration Association. Judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.
15. Changes to These Terms
We may update these Terms from time to time. The “Effective Date” at the top of this page indicates when the Terms were last revised. Your continued use of the Services constitutes your acceptance of the revised Terms.
